2010
U.S. v. Eggleston, No. 08-169-HA (D. Or. 7-19-2010) -- Defendant was charged with traveling across interstate lines to have sex with a minor, transporting child pornography in interstate commerce, and possession of child pornography. Defendant moved to suppress all statements and evidence seized during his arrest, arguing that the search of his motel room by Immigration and Customs Enforcement officers was unauthorized and illegal. The District Court agreed that ICE's entry into the motel room was unlawful, but asked the parties to submit additional briefing on how much evidence should be suppressed as a result of the illegal search.
