Effective Training in the Technology & Law of Computer Forensics
Computer forensics is quickly becoming one of the most important aspects of criminal law, and is rapidly finding its way into various civil fields as well, including domestic relations, intellectual property, and employment.
I offer interesting, cost-effective, CLE-certified training in this technical but fascinating area of the law. My 2-3 hour sessions are a great opportunity for members of your office or CJA panel to expand their familiarity with computer forensics, learn more about law enforcement procedures for search and seizure and digital investigations, and participate in a structured discussion with other defense attorneys about these issues. 2011 CLE Topics
Here are the topics on which I will be lecturing in the coming year:
Computer Forensics 101
This seminar provides attendees with the basic information that they need to understand the terminology, concepts, and technology of computer forensics. Among the topics covered:
- Why computer forensics is possible (hint: the delete key is a myth)
- How to read a law enforcement computer forensics report
- Deposition and cross-examination of computer forensics experts
- When to hire an independent computer forensics examiner in criminal or civil cases
- Trends in computer forensics court decisions
This seminar is scalable from 2-6 hours.
Mobile Search and Seizure
Personal privacy and defendants' rights got off to a bad start this year, when the California Supreme Court ruled on January 3 that police may conduct a warrantless search of cell phones seized incident to an arrest. The People v. Diaz, S166600 (Calif. January 3, 2011). Search and seizure issues are taking on particular importance in this day and age, as more and more personal information is carried in pocket-sized devices. This 1-2 hour seminar covers the following topics:
- Overview of mobile technology and data storage
- Trends in relevant federal and state court decisions
- The basics of mobile forensics
Peer-to-Peer and BitTorrents for Lawyers
Now that P2P software manufacturer LimeWire has been shut down by a U.S. District court, where are its 45 million or so users going to go for their pirated songs, movies, pornography, and child pornography? To open source alternatives like FrostWire and to competing P2P protocols like BitTorrent and Gnutella2. This 1-2 hour seminar explores the following topics:
- File-sharing technology
- Law enforcement investigative tools and techniques
- Possible defense theories
- Recent relevant court decisions

CLE Case Summaries
My monthly case summaries have been on hold over the last couple of months while I wrote my latest book, CyberTraps for the Young: How a Single Click Can Ruin Your Child's Life -- And What YOU Can Do About It. The book, which will be published April 1, is an overview of the legal problems that kids can get into through the use and misuse of electronic devices. The computer forensics case summaries will resume in February.
