Facts:
Thomas Mickelson pled guilty to one count of receiving child pornography in violation of 18 U.S.C. § 2252(a)(2)(A). Based on various stipulations during the sentencing hearing, the recommended sentence range was 41-51 months. Mickelson's counsel suggested that an appropriate sentence was at the lower end of the range, but requested a sentence in the range recommended by the sentencing guidelines.
The government introduced evidence at the sentencing hearing that Mickelson had used his computer to receive images of child pornography and distribute them to others. Some of the material uncovered by the government consisted of sexually explicit images of children under 12, and some involved sadistic or masochistic violence. Based in large part upon the forensic evidence, the trial court sentenced Mickelson to 51 months in prison, Mickelson appealed.

Rationale:
As a preliminary matter, the Court of Appeals noted that Mickelson stipulated to a sentencing guideline of 41-51 months. While that did not constitute a waiver of his right to appeal (as the government argued), the Court of Appeals noted that Mickelson's stipulation could serve as an acknowledgment of the reasonableness of any sentence in that range.
In this case, however, the trial court examined the evidence in light of the factors laid out in the sentencing guidelines and concluded that a sentence at the top of the range was appropriate. The trial court noted that Mickelson's offense (as evidenced by the contents of his comptuer) was "very serious." The trial court's conclusion was not unreasonable. |
