An unnamed Oregon woman, 18, struck a deal with prosecutors to avoid serving as many as 12 years in prison for her role in an April 2008 sexting incident. Her name was not reported because she was a minor when the illegal conduct took place.

According to state prosecutors, the defendant was at a raucous party at a beach rental. At some point during the evening, she wound up in a bedroom with a friend, a partly-naked  and drunk 16-year-old. Also in the room was David Simpson, then 30. The defendant used her cellphone to videotape Simpson's dog having what The Oregonian primly described as "oral contact" with the 16-year-old.

The defendant shared her cellphone video with various other individuals, but it was not reported to school officials until the following school year. The principal at the girls' school, Newport High School, reported the incident to the police.

The county prosecutor, Mike Flinn, told reporters that it was a difficult decision to strike a plea agreement with the defendant, in particular because she did not seem to think that the incident was serious.. On balance, however, Flinn concluded that it did not make sense to charge the defendant with two major felonies.

Judge Charles Littlehales agreed, noting that if she had been convicted on either charge, the defendant would have been required to register as a sex offender for the remainder of her life. Instead, the woman will serve 60 days in county jail, 20 days on a work crew, attend alcohol counseling, and spend 36 months on probation.

Prosecutors are also prosecuting Simpson for encouraging his pet to have illicit contact with a minor. He is scheduled to go to trial on Wednesday, but his attorney is attempting to negotiate a plea agreement. A third individual, Jess Carey, was convicted and received probation on a charge of failure to report child pornography.
